General Terms & Conditions (AGB)

§ 1 Scope of Application

These Terms and Conditions apply to all contracts between

(hereinafter "Seller") and the buyers (hereinafter "Customer") regarding the online purchase of posters and original paintings via the website [Website]. Any deviating customer conditions are not recognized.

§ 2 Contract Formation

The presentation of products on the website does not constitute a legally binding offer, but an invitation to order. By submitting the order, the Customer makes a binding offer. The contract is concluded when the Seller confirms the order by e-mail or ships the goods.

Custom-Made Works

For original paintings commissioned individually according to customer specifications, the contract is concluded upon order confirmation by e-mail. In this case, the right of withdrawal is excluded pursuant to § 312g (2) No. 1 BGB.

§ 3 Prices and Payment

All prices stated are final prices in Euro. As the Seller qualifies as a small business owner pursuant to § 19 UStG, no VAT is shown.
Available payment methods: PayPal, credit card. Payment is due upon order completion.

§ 4 Delivery and Shipping

Delivery AreaDelivery is made within Germany and to all EU Member States.

Delivery Times

Regarding the Prints: Within Germany: Up to 10 business days after receipt of payment. To other EU countries: up to 21 business days after receipt of payment, depending on destination country and shipping provider.
For original artworks (unique pieces), delivery times may vary depending on the size of the work, destination, and specific transport requirements. Due to the need for individual packaging, protective measures, and, where applicable, specialized or insured transport, longer delivery times may occur.
The estimated delivery time will be communicated to the Customer individually prior to conclusion of the contract.
In individual cases, collection by the Customer may be agreed upon after prior arrangement. The details of such collection will be determined through mutual communication.

Shipping Costs

Regarding the Prints: Within Germany: [Shipping costs to be specified] per order. To all other EU countries: [Shipping costs to be specified] per order. Shipping costs are clearly displayed during the ordering process before order completion.

For original artworks (unique pieces), shipping costs may also vary significantly depending on size, weight, packaging requirements, and destination country. Therefore, shipping costs for such items are determined individually upon request and communicated to the Customer before conclusion of the contract. The contract is only finalized once the Customer has confirmed acceptance of the stated shipping costs.

Shipping Risk

The Seller bears the shipping risk until handover to the Customer. Any damaged shipments must be reported immediately.

§ 5 Retention of Title

Delivered goods remain the property of the Seller until full payment has been received.

§ 6 Right of Withdrawal

Consumers have a statutory right of withdrawal as per the separate withdrawal instructions, which form part of these Terms and Conditions. The withdrawal period is 14 days from receipt of the goods. For custom-made original paintings, the right of withdrawal is excluded pursuant to § 312g (2) No. 1 BGB.

§ 7 Warranty

Statutory warranty rights apply. The warranty period is two years from delivery of the goods. For used goods or unique items, the period may be reduced to one year if expressly agreed.
Original paintings are handcrafted unique pieces. Natural variations in color, texture, and execution do not constitute defects but are characteristics of artisanal production.

§ 8 Copyright

All artworks displayed on the website are protected by copyright. Purchase transfers ownership of the physical work only, not usage or exploitation rights. Any reproduction, distribution, or public display requires the Seller's express written consent.

§ 9 Data Protection

Processing of personal data is governed by the Privacy Policy on the website [Website], which forms part of these Terms and Conditions.

§ 10 Dispute Resolution

The European Commission provides an online dispute resolution platform: https://ec.europa.eu/consumers/odr/. The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 11 Final Provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the Customer is a consumer residing in another EU Member State, the mandatory consumer protection provisions of their home country also apply.
Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions remains unaffected.
